This Privacy Policy explains how we collect, use, share, and safeguard your personal information when you use our applications, websites, and related services (collectively, the "Service").

By accessing or using our Service, you acknowledge and agree to the terms of this Privacy Policy. If you do not agree with this policy, please do not use our Service.

Exceptions: This Privacy Policy does not apply to information collected by third-party services, websites, or platforms accessible through our app, nor does it cover data collected by third-party advertising companies operating within our Service. Please refer to the respective privacy policies of those third parties.

2. Information We Collect

We only collect what is necessary to provide and improve our Service. We will never collect your personal information without your permission.

Account, Subscription & Credit Data: To manage your access to premium features, we collect data regarding your subscription status, subscription tier, and the balance of your in-app credits/tokens. We also record your credit consumption history when you utilize specific AI generation features.
Transaction Records: In-app purchases (such as subscribing to premium plans or purchasing credits) are processed securely through third-party platforms (e.g., Apple App Store or Google Play). We receive transaction receipts and status updates to fulfill your order, but we do not collect or store your sensitive payment details (like credit card numbers).
Information You Provide: If you contact us for support, feedback, or bug reports, we may collect your name, email address, and the contents of your message.
Technical Information: We utilize third-party tools which may collect pseudonymized device and browser data (e.g., IP address, device model, operating system, network type) to ensure app stability.
Service-Related Data: We collect abstracted, aggregated data regarding your usage of the Service (such as your country or internet service provider) to improve our app. You cannot be identified from this data.

3. AI Processing, Facial Data & Credit Consumption

To provide our core AI features (e.g., AI filters, templates, text-to-image, video generation, or headshots), we utilize advanced AI generation technologies. Using these advanced AI features will consume your account's credits/tokens based on the complexity of the generation.

How the AI Process Works:

You input a text prompt and/or upload an image/video.
Our system verifies your credit balance and deducts the corresponding credits for the requested task.
Our system detects the face in your photo and identifies essential facial key points (e.g., eyes, nose, mouth) required for the specific effect.
The AI applies the requested effect based on your prompt and the detected key points.

Data Protection Commitment:

No Permanent Storage: We do not permanently store or harvest your facial data.
Automatic Deletion: After the generation process is complete, the photos/videos you uploaded and the processed results are automatically deleted from our servers within 30 days.
No Biometric Identification: We do not use in-depth processing of your personal information to obtain biometric identification data.

4. How We Use Your Information

We process your personal information under applicable laws for the following purposes:

Service Delivery & Account Management: To operate our Service, manage your subscription benefits, track your credit balance, and accurately process credit deductions when you use AI features.
Customer Support: To communicate with you, restore your purchases/subscriptions, and respond to inquiries or privacy requests.
Improvement & Analytics: To understand how our Service is used, conduct research, monitor app stability, and optimize user experience.
Legal Compliance: To enforce our Terms of Service, resolve disputes, and comply with legal obligations or court orders.

Note: We do not sell or share your personal information with third parties for their direct marketing.

5. Third-Party Services & SDKs

To ensure app functionality, manage subscriptions, display advertisements, and provide advanced AI features, we integrate third-party Software Development Kits (SDKs) and Application Programming Interfaces (APIs). These providers may collect specific data directly from your device.

A. AI Content Generation Partners
To generate high-quality AI images, videos, and stylized animations, we securely share your text prompts, uploaded media files, and temporary facial geometry data with our trusted third-party AI service providers. These partners are strictly limited to using your data solely for fulfilling your generation request and are required to comply with our strict data retention policies (including the deletion of media files shortly after generation).

B. Advertising & Analytics Providers
We partner with third-party advertising networks and analytics platforms. These providers may collect technical data (such as your device's Advertising ID, IP address, and browsing behavior within the app) to serve relevant, interest-based ads and to help us understand app performance.

C. Cloud Storage & Crash Monitoring Services
We use third-party cloud infrastructure to temporarily host your edited contents and process support tickets. We also use crash reporting services that collect diagnostic data (like crash traces and installation IDs) to help us identify and fix bugs promptly.

D. Payment & Subscription Processors
All subscription renewals, credit top-ups, and in-app purchases are securely handled by the native platform processors (e.g., Apple App Store or Google Play).

6. Data Storage, Retention, and Security

Storage Location: We generally store your edited contents and credit balances securely via our cloud service partners. We ensure all personal information is subject to strict access controls and is safeguarded by reasonable technological and organizational measures.
Retention Period: We retain your account data, subscription records, and credit history for as long as your account is active to provide you with the Service. Support inquiries are deleted once the issue is resolved. AI-generated media is automatically deleted within 7 days.
Security Measures: We implement robust administrative, technical, and physical security measures to protect your data from unauthorized access, loss, or misuse. However, please be aware that no internet transmission or electronic storage is 100% secure.

7. Your Privacy Rights & Controls

Depending on your jurisdiction, you have specific rights regarding your personal data:

Withdraw Consent	Where processing is based on consent, you may withdraw it at any time via the app's "Settings" menu

How to exercise your rights:
You can delete your account and associated data directly within the app by navigating to Settings > Delete Account. For other requests, please contact our Data Protection Officer (see Section 10).

8. Children's Privacy

Our Service is not intended for children under 16. We do not knowingly collect personal information from children under 16. If you are a parent or guardian and believe we have unintentionally collected such data, please contact us immediately to request deletion.

9. Regional Privacy Disclosures

For California Residents (CCPA)
We do not sell your personal information. You have the right to request twice within a 12-month period:

The categories and specific pieces of personal information we have collected about you.
The sources from which the data was collected and the business purposes for collecting it.
The deletion of your personal information (subject to certain exceptions, such as fraud prevention).
Non-discrimination for exercising your privacy rights.

For EEA, UK, and Switzerland Residents (GDPR)
VidArt acts as both the Data Controller and Data Processor. If your data is transferred outside the European Region, we ensure appropriate safeguards (such as Standard Contractual Clauses) are in place. Under the GDPR, you retain the rights to access, rectify, erase, restrict, object to processing, and data portability. You also have the right to lodge a complaint with your local supervisory authority.
